
| The civil courts encourage parties to resolve disputes without the need for a court hearing. This is known as Alternative Dispute Resolution (ADR). Different methods of ADR include arbitration and mediation. ADR can take place before or after court proceedings are issued. At an arbitration, the parties put their case either with or without the assistance of lawyers, to a trained arbitrator. The parties usually agree to be bound by the arbitrator's decision. Mediation on the other hand, involves the use of a trained mediator to talk separately with each party in turn, in an endeavour to narrow down the issues between them and facilitate a compromise or settlement.
