Will Disputes

Are you involved in a dispute over a will? The Inheritance (Provision for Family and Dependants) Act 1975 means that certain categories of claimant, including husband, wife, child and co-habitees (of at least two years), can seek reasonable financial provision under a will if this has not been provided for. If someone has died without leaving a will, his or her estate will be distributed in accordance with the Rules of Intestacy. Again, the Act means that certain individuals can make a claim for reasonable financial provision if this is not provided under the Intestacy Rules.

We can also advise you if you believe that a will was made under duress, that the person making the will did not have mental capacity to do so or you believe that the will does not accurately reflect the intentions of the person making the will. We understand that it may be difficult and distressing to seek legal advice following the death of a partner or family member. We will provide straightforward, practical and cost-effective advice to help you decide whether you wish to pursue (or defend) a claim.
