
| Does someone owe you money? Alternatively, is someone bringing a claim against you for money? If your claim (or defence) involves more than £5,000, the court will give directions for the parties to exchange lists of documents and witness statements. There may also be a need for expert evidence. We can represent you in bringing (or defending) a claim, or we can provide advice and guidance to assist you in dealing with the claim yourself. From the outset, we will talk to you about the enforceability of a claim if it succeeds. If you obtain a judgment, the debtor may still not pay. If the judgment is not paid, the party who has the benefit of the judgment must enforce it by, for example, securing it against a property or obtaining a court order that instalments will be deducted from wages. If a claim is for less than £5,000, the court is likely to allocate it to the court's Small Claims Track. This means that only limited legal costs can be recovered.
